1. Introduction

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that was enacted on October 28, 1998. The DMCA implements two 1996 treaties of the World Intellectual Property Organization (WIPO) and is designed to update copyright laws for the digital age. This law provides a framework for addressing copyright infringement on the internet, particularly as it pertains to online service providers. The Service respects the intellectual property rights of others and expects users of this Platform to do the same. This DMCA policy outlines the procedures for reporting copyright infringement and the rights and responsibilities of all parties involved.

Under the DMCA, online service providers (OSPs) may qualify for 'safe harbor' protection from liability for copyright infringement committed by their users, provided they comply with certain requirements. To qualify for this protection, the OSP must not have actual knowledge of infringing material, must not be 'aware of facts or circumstances from which infringing activity is apparent,' and must act expeditiously to remove or disable access to the infringing material upon receiving proper notification from a copyright owner.

3. Notice of Infringement

To report a claim of copyright infringement, the copyright owner or an authorized representative must submit a written notice to the designated agent of The Service. The notice must include the following information: a physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner; identification of the copyrighted work claimed to be infringed; identification of the material that is claimed to be infringing; information sufficient to permit The Service to contact the complaining party; a statement that the complaining party has a good faith belief that the use of the material is not authorized by the copyright owner; and a statement that the information in the notice is accurate, under penalty of perjury.

4. Counter-Notice

If a user believes that material removed or disabled by The Service is not infringing, the user may submit a counter-notice. The counter-notice must include: the user's physical or electronic signature; identification of the material that has been removed or disabled; a statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and the user's name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court for the district in which the user resides.

5. Repeat Infringers

The Service reserves the right to terminate the accounts of users who are found to be repeat infringers of copyright law. A repeat infringer is defined as a user who has been notified of infringing activity more than twice and has failed to take appropriate action. The Service will implement a policy to terminate, in appropriate circumstances, accounts of users who are deemed repeat infringers.

6. Rights and Responsibilities

Both copyright owners and users have rights and responsibilities under the DMCA. Copyright owners have the right to protect their works from unauthorized use and to seek remedies for infringement. Users have the right to contest claims of infringement and to seek reinstatement of their material if they believe it was removed in error. It is important for both parties to understand the implications of the DMCA and to act in accordance with its provisions.

7. Limitations of Liability

The Service shall not be liable for any damages arising from the removal of content or the disabling of access to material in response to a DMCA notice. The Service does not endorse the content of any user and is not responsible for the actions of users who infringe on the rights of others. Users are encouraged to respect the intellectual property rights of others and to seek permission before using copyrighted material.

8. Changes to This Policy

The Service reserves the right to modify this DMCA policy at any time. Any changes will be effective immediately upon posting the revised policy on this Platform. Users are encouraged to review this policy periodically to stay informed about how The Service is protecting copyright and addressing infringement claims.
